Your use of Diva Spa's services is subject to these terms and conditions ("Our Terms"). These terms constitute a legally binding agreement between you and Diva Spa ("Diva Spa", "we", "us" or "our"). Diva Spa is a private company registered in Riyadh, Saudi Arabia.

Use of our services

Our Terms govern your use of our services. By using our services, you agree to comply with Our Terms. Please read Our Terms carefully and thoroughly. If you do not accept Our Terms, you must not make a booking through Diva Spa for any of our services.

Personal data

In order to provide our services, we may collect personal data from you. Before making a booking through us, please read our privacy policy [link to privacy policy].

Eligible use

You confirm that you are of legal age to access and use our services and are of legal capacity to agree to Our Terms. You are not eligible to use our services if you are under the age of 18.

Our services

Diva Spa provides at-home massage and therapy services in Riyadh, Saudi Arabia. Our services include:

• Massage services: Thai Massage, Swedish Massage, Shiatsu Massage, Foot Massage, Shoulder Massage, Candle Massage
• Other therapy services: Classic Pedicure & Manicure, Spa Pedicure & Manicure, Classic Moroccan Bath, Moroccan Baths + Hair Treatments, Hot Stones, Lymphatic Drainage, Aircup (Cupping Therapy)

Booking process

You can make a booking through our WhatsApp messaging service. Your payment details will be requested at the time of booking and payment will be collected when you make a booking. Full payment of the Treatment Fee is due at the time of booking the service. By making a booking, you are responsible for:

1. Full payment of the applicable Treatment Fee
2. Ensuring our therapist has access to your designated premises which must represent a suitable space in which the service can be performed, with all appropriate facilities (including adequate lighting and heating)
3. Ensuring the health and safety of our therapist whilst at your designated premises

Payment

All Treatment Fees are payable through our designated payment methods. We collect payment of Treatment Fees on behalf of Diva Spa. Our receipt of your payment discharges your debt to Diva Spa for the amount paid.

We will do all that we reasonably can to ensure that all of the information you give us when paying for the service is secure by using an encrypted secure payment mechanism. However, in the absence of negligence on our part, we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you give us.

Prices

All fees and charges are inclusive of VAT where applicable or unless specified otherwise. The price of our services varies according to the type and duration of the service you book. Full details of our prices are available upon request. Prices are liable to change at any time, but changes will not affect any booking which you have already made.

Your responsibilities

It is your responsibility to provide complete and accurate information at the time of booking. Failure to provide complete and accurate information may result in a rejection of your booking request, cancellation of your booking, or an inability of our therapist to provide the service as requested. Such failure may lead to your payments being ineligible for refund.

Cancellations and refunds

You have a contractual entitlement to cancel any booking you have made with us in the following circumstances and on the described terms:

1. If you cancel at least 24 hours prior to the appointment time, no cancellation fee will be charged.
2. If you cancel within 24 hours of the appointment time, a 30% cancellation fee will be charged.
3. If you cancel within 2 hours of the appointment time, or fail to show up for your appointment, the full Treatment Fee will be charged.

Cancellation fees may in our absolute discretion be waived where you have been unable to cancel a booking without incurring the cancellation fee for genuine reasons which were outside of your control.

Extensions and delays

If you wish to extend the time you have booked for a service, we will endeavour to fulfil your request. This is subject to the availability of our therapist and payment of an additional charge for the extended time.

If you are delayed and unable to start the service at the designated premises at the appointment time by more than 10 minutes then, unless our therapist agrees to the contrary:

1. Our therapist is entitled to end the service at the time agreed when the booking was made without making any adjustment to the Treatment Price to reflect the reduced time of the service; or
2. If you and our therapist agree to proceed with the service for the full time allotted notwithstanding the delayed start time, then you shall be obliged to pay an additional charge calculated at our standard rates for extra time.

Prohibited use

Our services are for your personal use only. You must not use our services to do any of the following (each of which is strictly prohibited):

1. Engage in any inappropriate behaviour including but not limited to illicit or sexually suggestive remarks, sexual advances, drug use, excessive drinking and/or other inappropriate behaviour
2. Harass, abuse, threaten or otherwise infringe or violate the rights of our therapists, Diva Spa (including its employees and personnel) or others
3. Use our services for any unlawful or unauthorised purposes

We reserve the right to disclose information of suspicious behaviour to law enforcement.

Intellectual property

DIVA SPA, the Diva Spa logo, brand and all other intellectual property rights, trademarks, service marks, graphics and logos used in connection with our services (whether registered or unregistered) belong to us and are protected by intellectual property law. Nothing in Our Terms grants you any rights in our services or the content within the same. All rights are reserved.

Disclaimer

Our services are for general wellness purposes only. Nothing contained in our services constitutes, or is meant to constitute, medical advice. We are not a healthcare provider nor do we provide medical advice or medical treatment. Should you have a medical issue you should always consult with a qualified medical professional.

We make no warranty or guarantee that our services are suitable for your intended use, error-free, timely, reliable, entirely secure, or available. We make no guarantee of particular results or outcomes by use of our services.

Governing law and jurisdiction

You agree that Our Terms for all purposes, shall be governed by and construed in accordance with the laws of Saudi Arabia. You also agree to submit to the exclusive jurisdiction of the Saudi courts as regards any claim or matter arising under Our Terms.
